Oceanside, CA Animal Ordinances: Pet Store Rules (2026)

City Code Sec. 5, adopted by Ord. No. 15-OR0026-1 effective January 21, 2015, prohibits a pet store or pet store operator from engaging in the retail sale of dogs or cats, defined to include displaying, offering for sale, bartering, auctioning, giving away, leasing or transferring, unless the animal came from an animal shelter, the sale fits one of the section's exemptions, or the store qualified as an 'existing pet store' allowed to continue selling dogs and cats it already carried until September 1, 2015. The exemptions cover animals born and reared on the selling premises, animals obtained from a 'noncommercial breeding establishment' (an operation that sold, transferred or gave away three or fewer litters, or fewer than twenty dogs or twenty cats, in the prior twelve months), publicly operated shelters, and humane societies or rescue organizations devoted to stray, abandoned or surrendered animals, including one operating out of a pet store.

A pet store may still host shelter or rescue animals on-site for adoption. Every dog or cat offered for sale must have a 'certificate of source' identifying where it came from posted within three feet of its kennel, cage or enclosure, and the operator must give a copy to the buyer at the time of sale or transfer.
