Chesapeake does not impose breed-specific restrictions. Virginia prohibits localities from adopting breed-specific bans under VA Code section 3.2-6540.1. Dangerous and vicious dog designations are behavior-based under VA Code section 3.2-6540 regardless of breed.
Virginia is one of roughly 22 states that preempts breed-specific legislation. VA Code section 3.2-6540.1 prohibits any Virginia locality from classifying a dog as dangerous or vicious solely based on breed. Chesapeake follows this framework through City Code Chapter 10 and the state Dangerous Dog Registry administered under VA Code section 3.2-6540. A dog of any breed (including pit bull-type dogs, Rottweilers, and German Shepherds) may be declared dangerous or vicious only after a specific biting or aggressive incident, adjudicated in General District Court. Owners of declared dangerous dogs face registration fees, mandatory microchipping, liability insurance of $100,000, muzzling in public, and a secure enclosure at home. HOAs and private insurers may still impose breed restrictions separately, which is not preempted by state law.
Failure to comply with dangerous dog conditions: Class 1 misdemeanor plus escalating registration fees. Vicious dog can result in court-ordered euthanasia.
