Albany, OR Animal Ordinances: Cat Rules (2026)

The only provisions in the Albany Municipal Code that name cats are § 6.10.040 and § 6.14.020, which makes it unlawful for any person to willfully abandon or desert a dog, cat or other domestic animal. Section 6.10.040 is the rule that reaches cat owners in the City of Albany, Oregon. It treats the animals described within chapter 6.10 and domestic cats as a public nuisance in six instances.

The first is an animal count above the number allowed by the chapter. That count is tied to § 6.10.010, which sets numbers for poultry, fowl, rabbits, and larger stock and prints no number for cats. The second is any animal or group of animals that make loud or frequent noises disruptful of any person's comfort or repose. The third is accumulated waste or other cause of offensive odors detectable from any right-of-way or adjoining property. The fourth is any animal that, when unprovoked, bites, kicks, scratches, or otherwise threatens the safety of any person. The fifth is an animal that habitually escapes from confinement and trespasses on public or private property, and trespass of more than two occasions is habitual under the section.

The sixth instance is an animal found running at large as defined by AMC § 6.12.010. That definition lists horses, mares, jacks, jennies, mules, sheep, cows, heifers, bulls, calves, hogs, and any kind of cattle, and does not name cats. Section 6.10.050 makes it unlawful for the owner or keeper to permit a public nuisance, § 6.10.060 makes the owner responsible for damage to private or public property, and § 6.10.070 presumes the adult occupants of a dwelling to be owners of animals on the same premises.
