Albany, OR Animal Ordinances: Exotic Pets (2026)

Albany Municipal Code § 6.10.030(2) is the City of Albany, Oregon's provision for unusual pets. It permits other house pets not covered elsewhere under Title 6, including exotic animals for which required state or federal permits have been obtained, if they are maintained within a dwelling or secure pen. Two conditions do the work: the permits the animal requires must already be in hand, and the animal must be kept inside the home or in a secure pen. The section does not print a list of banned species, and it does not create a City exotic-animal permit; the permit it refers to is the state or federal one. Subsection (1) of the section is shown as repealed by Ord. 5868.

Keeping an exotic pet does not take it out of the rest of chapter 6.10. Section 6.10.040 makes animals described within the chapter a public nuisance when they make loud or frequent noises disruptful of any person's comfort or repose, cause offensive odors detectable from any right-of-way or adjoining property, or, when unprovoked, bite, kick, scratch, or otherwise threaten the safety of any person. It is also a nuisance when an animal habitually escapes from confinement and trespasses on public or private property, and trespass of more than two occasions is habitual.

Under § 6.10.050 it is unlawful for the owner or keeper to permit a public nuisance. Section 6.10.060 makes the owner of an animal that causes damage to private or public property responsible for the damage, and § 6.10.070 presumes the adult occupants of a dwelling to be the owners or co-owners of any animals contained on the same premises. Cruelty to animals under § 6.14.010 defines animal to include birds.
