Summary

Keeping chickens or other fowl in Asheville requires an annual license under City Code § 3-50, and roosters are flatly prohibited unless grandfathered from a prior lawful nonconforming use. Fowl must meet the distance rules in § 3-9(a)(3) and stay in a fully enclosed, sanitary coop and run under § 3-52.

Sec. 3-50. License for keeping. (a) Except for fowl as part of a lawfully established, non-conforming use, or fowl participating in a permitted event, no fowl shall be kept by any person within the city except in accordance with this article. Roosters are expressly prohibited unless associated with a lawfully established, non-conforming use. Roosters previously permitted by the city are grandfathered for the life of the rooster so long as the owner of the rooster maintains compliance with this chapter and the rooster does not create a public nuisance. Licensing of all fowl will be required upon expiration of any existing fowl permit authorized by the city. (b) Fowl shall be permitted according to the distance requirements as set forth in subsection 3-9(a)(3). This paragraph shall not apply to fowl that reside exclusively inside the person's household.

Full Breakdown

Section 3-50(a) bars keeping fowl in the city outside a lawfully established nonconforming use or a permitted event unless the owner holds a license; roosters are expressly prohibited, though roosters previously permitted stay grandfathered for the life of the bird as long as the owner stays compliant and the rooster creates no public nuisance. Section 3-50(b) applies the § 3-9(a)(3) distance requirements to fowl, except fowl kept exclusively inside the owner's household. To get licensed, § 3-51(a) requires an annual fee set in the city's fees and charges manual and registration with the city's license-collecting agent, and the animal control administrator can inspect the property for compliance.

A license can be revoked at any time for violating its terms or any other chapter provision, and once revoked, § 3-51(b) gives the owner seven days to remove the fowl and any coop from the premises. Section 3-52 sets enclosure standards: the fowl house and run must be fully enclosed with fowl kept inside at all times, the house used only for fowl and built and ventilated for regular cleaning, the run well-drained to avoid standing moisture, the floor and walls kept clean with droppings and waste removed promptly, and the number and type of fowl matched to the size of the coop and run.

Violations & Fines

A license issued under § 3-51 is not a defense to any nuisance action brought under § 3-9(1) through (10), so a licensed, compliant coop can still be cited if it becomes a nuisance. Violating the license terms or any enclosure standard lets the animal control administrator revoke the license outright, forcing removal of the fowl and coop within seven days under § 3-51(b).

Frequently Asked Questions

Can I keep chickens in Asheville?
Yes, hens are allowed with an annual license from the city under § 3-50, registration with the license-collecting agent, and a fully enclosed, sanitary coop and run meeting § 3-52's standards. The animal control administrator can inspect the property for compliance.
Are roosters legal in Asheville?
No. Section 3-50(a) expressly prohibits roosters within the city unless tied to a lawfully established, nonconforming use, and even grandfathered roosters lose that protection if they create a public nuisance.
How far must a chicken coop be from my neighbor's house in Asheville?
Fowl must meet the distance requirements in § 3-9(a)(3), though that rule does not apply to fowl kept exclusively inside the owner's household under § 3-50(b).
