Davie Town Code Chapter 4, Article IV requires every dog to be on a leash, in the owner's presence, or fenced within the owner's property. A dog 'at large' is declared a public nuisance and may be impounded, with the owner subject to a fine up to $500 under Sec. 4-68.
The Town of Davie regulates dogs under Chapter 4, Article IV of its Code of Ordinances (originally Ord. No. 99-2). Section 4-61 defines a dog as being 'at large' when it is not (1) under the physical control of a responsible person by means of a leash, cord, or chain; (2) in the physical presence of the owner or person in custody; or (3) confined to the owner's real property by a fence built to keep the dog confined. The Town's published Dogs and Cats guidance states 'All dogs shall be kept secured by a leash or otherwise under the control of an owner or responsible person, or within the real property limits of the owners.' Davie's code does not specify a maximum leash length for ordinary walking. Section 4-63 declares any dog running at large within the town limits a public nuisance; a dog whose ownership cannot be established and that is creating a nuisance is impounded by the Town and transferred to an animal shelter. An owner of a dog at large may be prosecuted as a municipal ordinance violation in Broward County court (Sec. 4-68) or before the Town's code enforcement special magistrate under Chapter 162, F.S. The code expressly excludes dogs actually working livestock, retrieving game for a licensed hunter, or being exercised under the owner's supervision from 'at large' - a nod to Davie's working-ranch heritage. Rabies vaccination and a county dog license are separately required under Sec. 4-62, with tags issued through Broward County Animal Care.
Allowing a dog to run at large is a Town code violation. Under Sec. 4-68, a person convicted of, or pleading guilty or nolo contendere to, a Chapter 4 violation may be fined up to $500 plus reasonable court costs. A dog at large may be impounded and transferred to an animal shelter under Sec. 4-63; the owner is responsible for impound costs to redeem the animal. The Town may prosecute either as a municipal ordinance violation in Broward County court (Sec. 4-68) or before the code enforcement special magistrate under Chapter 162, F.S. The town need not prove the owner's knowledge or neglect.
