Veterinary clinics are regulated through the use table in § 300-21.3 of the Consolidated Zoning Ordinance of the Town of Union, Village of Johnson City, and Village of Endicott, which § 300-10.4 applies in the Town and both Villages. Section 300-66.7 requires findings that the use will be compatible with existing nearby uses, will not tend to depreciate the value of adjacent property and will not create a hazard to health, safety or the general welfare. Section 300-66.8 lets the Board attach conditions to prevent or minimize adverse effects on neighboring property. The code separately defines an animal hospital as a facility run by a Doctor of Veterinary Medicine where animals are kept during recovery or treatment, and the definition allows boarding of animals. Violations & Fines
Operating a veterinary clinic where Table 21-2 does not allow it, or outside the terms of an approved special permit, is a violation under § 300-60.6.1. Under § 300-60.7 a conviction carries a fine up to and not to exceed $250, up to 15 days in jail, or both, and each day is a separate violation. The Town's enforcement costs, including attorney, engineering, consultant and court expenses, become the owner's obligation and can be assessed against the property as a lien.
