Summary
In the Town of Union outside the Villages of Endicott and Johnson City, Town of Union Code § 300-40.19 makes it unlawful to park a trailer, recreational vehicle, or boat on any street, alley, right-of-way, or other public place. On a residential lot these vehicles are allowed only as accessory storage, outside the required side or rear setback, with a minimum front setback of 10 feet.
It shall be unlawful for any person, firm or corporation to park a trailer, recreational vehicle or boat on any street, alley, right-of-way or other public place. No trailer, recreational vehicle or boat shall be parked, used or occupied on any tract or parcel of land except as herein provided: A. Trailers, recreational vehicles and boats may be placed on a residential lot as an accessory use for the purpose of storage of such trailers, recreational vehicles or boats, but shall not be parked within the required accessory side or rear setback of the premises, shall maintain a minimum front setback of 10 feet and shall comply with § 300-53.14, Visibility at intersections. For the purpose of clarity, storage as defined in this subsection is an accessory use and shall not be permitted where no primary use exists. B. This section does not affect trailer, boat and recreational vehicle sales or rental in a designated Commercial or Industrial District.
Full Breakdown
Section 300-40.19, titled Trailers, boats and recreational vehicles, was amended 3-16-2016 by L.L. No. 2-2016. It opens with a flat prohibition: it is unlawful for any person, firm or corporation to park a trailer, recreational vehicle or boat on any street, alley, right-of-way or other public place. It then adds that no trailer, recreational vehicle or boat shall be parked, used or occupied on any tract or parcel of land except as the section provides.
Subsection A is the residential rule. Trailers, recreational vehicles and boats are allowed on a residential lot as an accessory use for the purpose of storage. They cannot be parked within the required accessory side or rear setback of the premises, and they must maintain a minimum front setback of 10 feet. The vehicle also has to comply with § 300-53.14, Visibility at intersections. On corner lots, no obstruction of vision can be parked or placed within the triangular area formed by the intersecting street lines and a straight line joining points 25 feet from the intersection along those lines, and shrubbery or solid fences in that area cannot be higher than two feet from the accepted street grade.
The code states that storage in this sense is an accessory use and is not permitted where no primary use exists, so a lot with no primary use cannot hold a stored boat or camper. Subsection A authorizes storage; the opening sentence is the one that bars parking, using, or occupying these vehicles on a parcel except as the section provides.
Subsection B leaves trailer, boat and recreational vehicle sales or rental in a designated Commercial or Industrial District untouched. Separately, § 300-40.12(B) allows mobile homes and trailers as temporary facilities at construction sites after building permits are issued for the proposed principal building, with removal required on expiration of the building permit or on issuance of a certificate of occupancy from the Administrative Officer.
Violations & Fines
A violation of the zoning chapter is punishable under § 300-60.7 by a penalty or fine up to and not to exceed $250, or imprisonment of not more than 15 days, or both, and each day the violation continues is a separate violation. The Town's attorney, engineering, consultant, and court costs become an obligation of the owner and can be levied on the real property as a lien. Section 300-60.6.1 treats any activity out of compliance with the chapter as a violation.
