Section 191-20 of the Town of Union Code, added in 2000 and amended in 2005 and 2011, has two separate restrictions, and they cover different places.

Subsection A applies to streets and public parking areas. Vehicles having a total gross weight in excess of 8,000 pounds shall not be parked on any street or any public parking area in the Town of Union outside the municipal boundaries of the Village of Endicott and Johnson City that is located in or continuous to one of six zoning districts: Rural Residential (RR), Suburban Single-Family (SSF), Urban Single-Family (USF), Urban Two-Family (UTF), Urban Multifamily (UMF) and Suburban Multifamily (SMF). The words "in or continuous to" mean a street next to one of those districts is covered even if the street itself sits in another district.

Subsection B applies to private residential property. Commercial trucks, including any commercial trailers towed by such trucks, with a weight class GVWR of 8 (33,000 or more pounds) or higher cannot be parked on any residential property zoned SSF, USF, UTF, UMF or SMF. Rural Residential is not on the Subsection B list, so the heavy-truck ban on private lots reaches five districts while the 8,000-pound street ban reaches six.

The two thresholds matter. A pickup or van over 8,000 pounds gross weight is caught on the street under Subsection A but is not a class 8 truck under Subsection B. A tractor-trailer rig is caught by both.

Chapter 191 also contains separate truck exclusions in § 191-25, which exclude all trucks from Catalina Boulevard, Monterey Drive, Valley View Drive and Ventura Boulevard between the limits printed in the code, and set a 5 ton limit on Airport Road. Those exclusions do not stop delivery or pickup of merchandise along the excluded streets. Under § 191-21, a vehicle parked where parking is prohibited can be removed by the Town of Union Highway Department.

Violations & Fines

Subsection C makes a violation of § 191-20 punishable under § 191-29, and that penalty reaches both the person and the vehicle owner. A first conviction carries a fine of not more than $100 or imprisonment for not more than 15 days, or both. A second conviction within 18 months carries a fine of not more than $200 or not more than 45 days. A third or subsequent conviction within 18 months after the first carries a fine of not more than $300 or not more than 90 days.
