Before any license issues, Sec. 46-434 requires the business license department to route the application to the health department, fire department and building department for a thorough joint investigation of the premises; the license only issues once all three departments submit written approval and Sec. 46-399's standards plus the safety certificate under Sec. 46-435 are satisfied. Every day care center must also remain open at all reasonable times to inspection by those same three departments under Sec. 46-397. A vehicle used to transport children must carry a Secretary of State safety inspection certificate showing compliance with the Illinois Vehicle Code.
Centers must maintain an observation room for ill or contagious children (Sec. 46-401) and report communicable disease cases to the health department daily (Sec. 46-402).
Violations & Fines
Operating without meeting these standards or without the required license is a violation of Article IX punishable under Sec. 46-398 by a fine of not less than $25.00 nor more than $750.00 per offense. The Commissioner of Public Health may order a day care center closed immediately if an inspection shows continued operation would seriously menace public health and safety. A license may also be denied or revoked under Sec. 46-437 for violations of the article or its minimum standards.
