Duluth, MN Building Safety: Childcare Center Rules (2026)

The Airport Overlay in the Unified Development Chapter (Chapter 50) creates four Safety Zones around Duluth International Airport (DLH) to keep population density down in the areas most exposed to an aircraft accident. 5 carries its own list of prohibited building classifications by use and occupancy: childcare or daycare centers, state-licensed residential care facilities and housing-with-services establishments serving seven or more people, state-licensed adult daycare serving 13 or more people, state-licensed group family daycare serving 13 or more children, and public or private schools and hospitals are all barred outright, regardless of the underlying zoning district's use table.

That sits alongside Safety Zone 1, which bans buildings entirely and limits uses to things like agriculture, cemeteries and parking, and Safety Zone 2, which bans Group A, E, I-2 and R-1 occupancy classifications under the Minnesota State Building Code and caps site population at 20 persons per acre. All of these restrictions trace back to the Duluth International Airport Zoning Ordinance, adopted by the Duluth International Airport Joint Zoning Board and recorded with the St. Louis County Recorder as Document Number 01432556, and the Land Use Supervisor enforces them and reviews any permit or variance application.
