030 amends the NFPA 101 Life Safety Code, 2012 edition, to define which childcare operations Elgin treats as regulated day-care facilities. An unlicensed operation counts as a day care center once it regularly cares for more than 8 children in a family home, or more than 3 children in a non-family-home setting, for less than 24 hours a day; a facility licensed by the state Department of Children and Family Services is always covered. A family day-care home is an unlicensed family home caring for more than 3 up to a maximum of 12 children under 24 hours, counting the family's own children under 12; a group day-care home follows the same structure but tops out at 16 children.

Child-to-staff ratios must comply with 89 Ill. Admin. , which override any conflicting Life Safety Code ratio. One- and two-family dwelling provisions in Chapter 24 of the Life Safety Code are adopted only as recommended guidelines, not mandatory requirements, for these home-based operations. Where clients occupy a level below the exit discharge level, the code requires either one-hour fire-resistance rated separation of the egress path, or interconnected smoke detectors on every level plus a sprinklered basement egress path; a secondary escape window's sill must sit within 44 inches of the floor, or a fixed stair or ramp must bring occupants within that 44-inch reach. 020, enforces these standards.
