Fountain Valley Municipal Code § 21.30.020 provides locational and operational standards for day care facilities in the City of Fountain Valley, in compliance with state law. The section states that its standards apply in addition to the other provisions of Title 21 and to requirements imposed by the California Department of Social Services. A day care center therefore answers to two separate regulators: the City through its Development Code, and the State through licensing.\n\nThe code defines a 'child day care center' as a day care center for fifteen or more children.

That headcount is the dividing line from a family daycare home, which tops out at fourteen children in the provider's own residence and needs no city land use permit.
