North Hempstead, NY Building Safety: Carbon Monoxide Detectors (2026)

Section 9-16, added in 2014, applies to every person holding or required to hold a place of assembly or place of public assembly license under Chapter 9, which covers buildings accommodating 49 people or fewer as a place of assembly and 50 or more as a place of public assembly. Existing indoor places must have properly operational carbon monoxide detectors or alarms, either hard-wired or plug-in, while all new construction must use hard-wired units. Detectors must be positioned according to the manufacturer's specifications relative to every actual or potential carbon monoxide source on the premises, including fuel-fired furnaces and boilers, space heaters, kerosene heaters, wood stoves, fireplaces, gas or liquid-fuel stoves, ovens, dryers and water heaters, and garages, and on each floor directly above such a source.

Section 9-16 also bars removing or disabling a detector except for service, repair or replacement, and specifically prohibits using any combination smoke detector and carbon monoxide detector device in a licensed place of assembly. The Building Commissioner may adopt further rules on quality, periodic maintenance and testing. 1, the section took effect upon filing with the Secretary of State, but the Town gave licensees a grace period, charging no violation before July 1, 2014.
