Summary

Hempstead does not require a blanket sprinkler system in every dwelling. Instead, § 88-12I lets a pre-1952 multiple residence install an automatic sprinkler system on each story as an alternative to fire-retarding the entrance hall and stairs, but only when the building's occupancy is increased by adding rooms or apartments.

Increase in occupancy. If the number of rooms or apartments in any multiple residence erected prior to July 1, 1952, is altered as to increase the occupancy of such building, the entrance hall, stair shall and their ceilings shall be fire retarded. In lieu of such required fire retarding, there may be installed an automatic sprinkler system, equipped on each story with heads in such number and so spaced as to protect the complete area of the public halls and stairs.

Full Breakdown

The alternative applies narrowly, not as a blanket mandate: § 88-12K similarly lets an owner sprinkler, instead of fire-retard, the ceiling of a business space operating inside a pre-1952 multiple residence, and § 88-12Z(2) lets a public hall or stairway in a pre-1952 building three or more stories tall satisfy fire-retarding requirements by installing a sprinkler system throughout instead of fireproofing every opening. Boiler and furnace rooms in pre-1952 multiple residences taller than three stories face the same either/or choice under § 88-12DD(1): sprinkler the room, or enclose it in a fire-resistant room with a two-hour rating and self-closing fireproof doors.

Where a sprinkler system is actually installed to satisfy any of these requirements, § 88-12X requires the owner to have it tested and inspected annually, keep one copy of the test on the premises for inspection, and file the other with the Manager of the Building Department, correcting any defects immediately. Outside the multiple-residence context, Chapter 88 imposes narrower sprinkler duties tied to specific hazards, such as kitchens or pantries connected to a place of public assembly under § 88-12W(1), rather than a general residential sprinkler mandate covering one- and two-family homes.

Violations & Fines

Failing to have a required sprinkler system tested and inspected annually, or failing to file the test results with the Manager of the Building Department, violates § 88-12X. Choosing neither the fire-retarding nor the sprinkler alternative where one is required under § 88-12I, K, Z or DD leaves the building out of compliance with Chapter 88 and subject to the Manager's enforcement notice and hearing process under § 88-3.

Frequently Asked Questions

Does Hempstead require sprinklers in every home?
No. Chapter 88's sprinkler provisions apply to multiple residences, mainly buildings erected before July 1, 1952, and mostly function as an alternative to fire-retarding materials rather than a universal mandate. One- and two-family homes are not covered by these specific sprinkler sections.
When can a multiple residence owner choose a sprinkler system instead of fire-retarding?
Section 88-12I allows it when a pre-1952 building's occupancy increases by adding rooms or apartments, and § 88-12K allows it for a business space's ceiling inside a pre-1952 multiple residence. Boiler rooms in taller pre-1952 buildings get the same choice under § 88-12DD(1).
What maintenance does an installed sprinkler system need?
Section 88-12X requires the owner to have any required sprinkler system tested and inspected annually, keep one copy of the results on the premises for inspection, file the other copy with the Manager of the Building Department, and correct any defects immediately.
