Elizabeth, NJ Building Safety: Building Inspections (2026)

City Code Section 15.04.010 establishes Elizabeth's state uniform construction code enforcing agency, formally named the "department of construction, division of building inspections." That agency is staffed with a construction official plus a fire protection subcode official, building subcode official, electrical subcode official and plumbing subcode official, along with additional subcode officials for any further subcodes the state Commissioner of the Department of Community Affairs adopts. The construction official serves as chief administrator of the enforcing agency and holds primary administrative responsibility for issuing all construction permits and certificates of occupancy in the city.

Each subcode has its own inspection track. Building inspectors and the building subcode official make all building subcode inspections and report recommendations to the construction official when he or she reviews a construction permit application. Electrical inspectors and the electrical subcode official inspect electrical work, report to the construction official on permit applications, and separately hold authority to order service connections or disconnections with the local power company for public health or safety reasons. Plumbing inspectors report to the construction official on plumbing permit applications. Fire protection subcode officials and inspectors, though city fire department employees, report to the construction official for Uniform Construction Code Act purposes and inspect for fire protection compliance.

Section 15.04.020(B) requires that the public be able to do business with the enforcing agency at one office location, except during emergencies or unavoidable circumstances. For demolition, Section 15.04.045(C)(10) shows how inspection is tied to specific construction stages: footings, foundations and slabs must be removed and inspected by the construction official before any clean fill is installed on the site, and a certified soil-testing letter must likewise be inspected by the bureau of construction before fill is placed. Overall administration of the bureau of construction, including building inspections under Chapter 15.04 and the city building code, sits with the director of planning and community development per Section 2.48.130.
