Summary

Brick Township sets minimum front, side, and rear yard setbacks separately for each zoning district in Chapter 245's Schedule of Area, Yard and Building Requirements, with special waterfront and deck exceptions written into § 245-10.

Notwithstanding any other provisions of the chapter, the minimum rear yard setback requirements set forth on said schedule for any principle structure shall be the applicable setback requirements for accessory uses from any property line abutting any body of water with the exception of in-ground swimming pools. In-ground swimming pools shall be subject to the setback requirements set forth in § 245-36.

C. Notwithstanding any other provisions of this chapter, the minimum setback requirement set forth on said schedule shall not be applicable to the location of a deck, as defined herein, along a rear yard or side yard of any principal building in any residential zone.

D. Notwithstanding any other provisions of the chapter, the minimum setback on said schedule shall not exceed 35 feet from an abutting body of water for any accessory.
