Newark, OH Building Setbacks & Zoning: Structure Height Limits (2026)

Newark City Council writes height limits into each zoning district chapter, in a section numbered .07 and titled Height Restrictions. The two-family district in Chapter 1252, labeled TFR Two-Family Residence District, is a clear example. Section 1252.07(a) caps a principal building or structure at three stories or forty feet, and caps an accessory building or structure at one and one-half stories or twenty feet. Section 1252.07(b) adds that flagpoles, television and radio antennas cannot exceed the height of existing buildings on the property by more than four feet.

Other residential chapters in the City of Newark, Ohio, set different ceilings. Section 1248.07 allows a principal building or structure two and one-half stories or thirty feet and holds an accessory building to one and one-half stories or twenty feet. Section 1249.07, for the Single-Family Residence Zero Lot Line District, allows two stories or thirty feet. Section 1250.07, for the Single-Family Manufactured Home District, says no structure shall exceed two stories or twenty-five feet. Section 1251.07, for the Single-Family Condominium District, allows two and one-half stories or thirty feet. The MFR Multi-Family Residence District in Section 1253.07 matches the two-family district at three stories or forty feet for a principal building and one and one-half stories or twenty feet for an accessory structure.

Two cross-references matter in the two-family district. Section 1252.05 sends accessory structures, including garages, sheds and pools, to Chapter 1274. Section 1252.14 lets a single-family dwelling on a lot that existed when the Code was adopted be repaired, altered or enlarged under Chapters 1242, 1248, 1249 or 1251, as determined by the Zoning Inspector. Section 1252.08 sets lot area, frontage and yard minimums in a separate table, so height is only one of the numbers a plan has to meet.
