Clarkstown, NY Business Licensing & Operations: Adult Entertainment (2026)

Town Code Chapter 290, Part 2 (Article XIV, Locational Requirements) bars the Building Department from issuing a permit for a new or substantially enlarged adult bookstore, adult motion-picture theater or adult dancing establishment within 1,000 feet of another such establishment, within 1,000 feet of any preexisting religious institution or school, within 1,000 feet of a residentially zoned area, or within 500 feet of a commercial establishment licensed to sell or dispense alcohol for on-premises consumption under § 290-76. "Substantial enlargement" means growing the licensed premises by more than 10% of its original size.

Distances are measured under § 290-78 in a straight line from the nearest wall of the adult use to the nearest property line of the protected use, ignoring intervening buildings. Beyond the spacing rule, § 290-77 requires the Commission for Adult Entertainment to find the use compatible with the surrounding neighborhood before granting conditional use approval, though it may waive the § 290-76 distances if it finds the waiver will not harm nearby properties and the operator will otherwise follow every Part 2 regulation. Operators separately need a classified license under § 290-47: no adult bookstore, theater or dancing establishment may do business without one, and each license covers one classification at one location.

Applications go to the Building Official (§ 290-49), and the Building Official can deny a license under § 290-48 if the Rockland County Department of Health, Fire Inspector or Building Department finds the premises fails any building, zoning, health or fire requirement, or if the applicant's license was previously revoked or suspended. Annual license fees under § 290-59 run $500 for an adult bookstore, up to $1,000 for an adult dancing establishment, and per-booth or per-seat rates for adult motion-picture theaters; operating two categories at one premises costs $1,000.

If an area is later rezoned residential within 1,000 feet of an existing licensed establishment, § 290-80 grandfathers that business only as a nonconforming use as of the rezoning's effective date.
