Clarkstown, NY Business Licensing & Operations: Massage Establishments (2026)

Under Town Code § 126-2, it is unlawful for any person to operate a massage establishment on any premises in the Town without first obtaining a business license from the Clarkstown Building Inspector. Section 126-3 requires the applicant to file the application in triplicate, and lets the Building Inspector refer it to the Police Department to inspect the premises and make written recommendations on compliance with Town codes and state or federal law. The Building Inspector has 60 days from receiving that recommendation to grant, deny, or hold the application for further review, with any additional review period capped at 30 days unless the applicant agrees otherwise.

The Building Inspector may deny an application under § 126-3(D) if the proposed operation would not comply with applicable building, fire, or zoning codes, or if the applicant or anyone involved in managing the establishment has been convicted of a felony, an offense involving sexual misconduct with children, or soliciting for a prostitute, pimping, prostitution, or a misdemeanor involving moral turpitude. A denial is reviewable by the Zoning Board of Appeals under § 126-4 upon written request filed within 30 days. Section 126-8 separately requires every licensed establishment to employ at least one licensed massage therapist, and § 126-6 requires extensive applicant disclosures including fingerprints, photograph, three years of addresses and employment history, and any prior license revocations.

A massage establishment license, once issued, runs for the life of the tenancy and is valid only for the individuals named on the application, per § 126-3(F).
