Mesa, AZ Business Licensing & Operations: Adult Entertainment (2026)

Mesa City Code Title 6, Chapter 16 regulates sexually oriented businesses, a category covering adult arcades, bookstores, cabarets, motels, theaters, nude model studios, sexual encounter centers, and adult novelty stores (Section 6-16-2). Section 6-16-3 makes it unlawful to operate one without a license issued by the Tax and Licensing Administrator, and unlawful for employees to work there without an employee license; applications go through the Chief of Police, including fingerprinting. Section 6-16-5 sets a $500 nonrefundable application and investigation fee plus a $500 annual license fee for the business, and a $50 fee for each employee license.

The core zoning restriction is Section 6-16-12: a sexually oriented business may operate only in the C-3 (General Commercial), M-1 (Limited Industrial), M-2 (General Industrial), or PEP (Planned Employment Park) zoning districts, and may not locate within 1,000 feet of a church, public or private school, day care/preschool, the boundary of a residential district, a public park, a residential lot, another sexually oriented business, or certain bar-license liquor establishments, measured in a straight line. Lawfully operating businesses that predate the chapter get a grandfathered three-year compliance window (Section 6-16-12(G)).

The Tax and Licensing Administrator can suspend a license up to 30 days or revoke it for code violations, illegal gambling, prostitution, or repeat convictions on the premises (Sections 6-16-8, 6-16-9), and a denied, suspended, or revoked license can be appealed to the Arizona Superior Court within 30 days (Section 6-16-10). An applicant denied for a location violation may separately petition the Board of Adjustment for a locational exemption within 10 days (Section 6-16-13).
