Chapter 5.07 requires every sexually oriented business, including any establishment newly opened, converted, added to an existing SOB, or relocated, to hold a valid permit issued by the Town's Licensing Officer, the Town Clerk, before opening, under § 5.07.100(a). Operating without a permit, or with one that is suspended, revoked or expired, is unlawful under § 5.07.100(b). Before starting work at a licensed premises, every employee must file notice with the Licensing Officer, submit fingerprints, and get approval within ten days, with an investigation fee of $50 for that employee review under § 5.07.100(c).

The permit application itself, filed under § 5.07.110, must include a current land-surveyor's certificate showing the property lines of any religious assembly, school, library, daycare, dwelling unit, public park, residential district, recreational facility or pawnbroker within 400 feet of the proposed site, and the property lines of any other sexually oriented business within that same 400-foot radius, under § 5.07.110(e)(11). The Planning Director checks compliance with the Zoning Code's locational standards, and the Licensing Officer must grant a permit within fourteen days of a complete application unless a listed ground for denial applies, such as a location that fails Subsection 13.04.130(d) of the Code, an unpaid sales tax license, a prior SOB permit suspension or revocation elsewhere in Colorado within twelve months, or a disqualifying sex-offense or related conviction, under §§ 5.07.140(b) and (c).

Permits expire one year after issuance and can be suspended up to thirty days or revoked by the Licensing Officer for violations such as allowing prostitution, drug activity or repeated public-peace disturbances on the premises, under §§ 5.07.150, 5.07.160 and 5.07.170, with appeals going to the Town Administrator under § 5.07.190.
