Summary
In the City of Berwyn, Illinois, no one may operate a massage establishment without a business regulation certificate from the City Collector, granted on approval of the Mayor or the Mayor's representative. Health, Fire and Building inspect first, and every masseur or masseuse also needs a state license.
(A) Required. No person shall engage in, conduct or carry on, or permit to be engaged in, conducted or carried on, upon any premises in the city, the operation of a massage establishment without first obtaining a business regulation certificate therefor from the City Collector, pursuant to the approval of the Administrative Official. (B) Application procedure. (1) Every applicant for a business regulation certificate to maintain, operate or conduct a massage establishment shall file an application in duplicate, under oath, with the City Collector upon a form provided by the Collector. The Collector shall, within 15 days thereafter, refer copies of the application and all additional information to the Health Department, the Fire Department, the Building Department and the Administrative Official. The departments shall, within 45 days, inspect the premises proposed to be operated as a massage establishment and make recommendations to the Administrative Official concerning compliance with these Codified Ordinances.
Full Breakdown
Chapter 855 of the Berwyn Code of Ordinances runs massage establishments through a discretionary approval process. Under § 855.02(A), the City Collector issues the business regulation certificate, but only pursuant to the approval of the Administrative Official, defined as the Mayor or the Mayor's authorized representative, who enforces the chapter.
The applicant files in duplicate, under oath. Within 15 days the Collector sends copies to the Health Department, the Fire Department, the Building Department and the Administrative Official. Those departments have 45 days to inspect the premises and recommend. The Administrative Official then grants, denies or holds the application for further investigation, and the hold cannot exceed 30 more days unless the applicant agrees. Refusals come with written reasons.
The application must state the exact nature of the massage to be administered and give the location and facilities. Each applicant, partner, officer, director and any stockholder holding more than 10% of the stock provides proof of being at least 18, residential addresses for three years, employment history for three years, prior massage business experience, any denial, revocation or suspension of a massage license anywhere, and any conviction, bond forfeiture or nolo contendere plea within five years, excluding minor traffic violations.
The certificate is refused if the operation would violate state or city law, including the Building, Health Planning, Housing, Fire Prevention and Zoning Codes, or if anyone managing it has a felony conviction or a child sexual misconduct offense.
Masseurs and masseuses, under § 855.03, must first be licensed by the State of Illinois and obtain a business registration certificate from the City Collector. The Board of Health and Police Department inspect each establishment at least twice a year under § 855.08. Operating rules cover posted price rates, clean linens, separate dressing rooms, and a minimum employee age of 18. Ads must carry the certificate number, and the certificate must be displayed where entering customers see it. Hospitals, nursing homes, licensed physicians, barbers, cosmetologists and sports participants are exempt under § 855.11.
Violations & Fines
Operating without the certificate violates § 855.02(A). Chapter 855 sends penalties to the general code penalty in § 202.99: a fine of not more than $2,000 per violation, each day a separate offense. The Administrative Official can revoke or suspend a certificate after 15 days' written notice and a Chapter 292 hearing. After a revocation, no certificate issues for one year for a massage establishment at the same premises.
