Section 5.20.040 makes it unlawful for any individual to provide massage for compensation in the City without a current State Certificate issued by the California Massage Therapy Council, and unlawful for any massage business, including a sole provider, to operate without a City Operator's Permit and a business license. Under Section 5.20.060, applicants file with the Permit Administrator (the Finance Director or designee), pay a nonrefundable investigation fee set by Council resolution, and disclose ownership type, the business address, all operators, and every employee or independent contractor.

Section 5.20.070's eligibility criteria bar issuance to anyone convicted within the past eight years of a felony, misdemeanor, infraction or municipal code violation substantially related to massage work, or who has had a similar permit denied, suspended or revoked elsewhere. The Permit Administrator has up to 60 days after receiving a complete application to investigate and approve, conditionally approve or deny it under Section 5.20.070, and denials may be appealed under Section 5.20.170. Permits run for one year from issuance under Section 5.20.150 and renew by application at least 60 days before expiration.

Section 5.20.120 bars outcall massage in a hotel, motel room or the provider's private residence and prohibits any outcall massage between 10:00 p.m. and 7:00 a.m. Section 5.20.030 authorizes the Sheriff's Department to assist in investigations and enforcement.
