Each of Huntsville's principal business-district articles in the Zoning Ordinance (Appendix A) works the same way: land in the district shall be used only for a specific list of uses, so anything left off the list, or specifically excluded from it, is not a lawful use no matter how similar it looks to what is allowed. Section 20.1.1 for the Neighborhood Business C-1 district lists barbershops, beauty parlors, reducing salons and fitness/exercise centers, excluding tattoo and body piercing parlors, so a personal-care storefront in a C-1 strip center cannot double as a tattoo studio. Section 27.1 for the Village Business C-6 district repeats the identical carve-out word for word.

The General Business C-3 district's section 23.1 and the Central Business C-B downtown district's section 26.1 go further, naming tattoo and body piercing parlors in the catch-all clause that would otherwise sweep in any use similar to and fitting within the district's enumerated categories; both sections list tattoo and body piercing parlors alongside off-premises liquor retailers and flea markets (and, in C-3, trailer parks and car wash facilities) as uses the catch-all cannot reach. Because the code enumerates permitted uses affirmatively rather than listing prohibited ones, a use is barred by omission in every district whose list does not mention it, and barred expressly in the four districts above where the drafters called it out specifically. A tattoo studio operator has to identify a district, such as Highway Business C-4 or Commercial Recreation C-5, where the use is not affirmatively closed off, and confirm that district's own use list before applying for a building permit or privilege license.
