Full Breakdown
90 makes it unlawful for anyone to act as a tobacco retailer in Alhambra without first obtaining a valid tobacco retailer's license for each location, effective January 1, 2022. "Tobacco retailer" covers anyone selling or exchanging tobacco, tobacco products, or tobacco paraphernalia for consideration, which reaches vape shops and e-cigarette retailers along with traditional tobacco stores. Licensees must display the license prominently, keep windows unobstructed so law enforcement can see the register area, and cannot cover more than 10% of window area with signage unless the zoning code is stricter.
Self-service displays are banned; locked cabinets need a conspicuous sign. Clerks must check ID for anyone who appears under 27 and refuse sale without valid photo identification proving legal purchase age. The Police Department and Code Enforcement Division monitor compliance, including unannounced inspections and youth decoy sting operations using supervised minors aged 15 to 17. The license fee is set periodically by City Council resolution and is capped at the cost of administering the program; fees fund retailer education, inspections, and enforcement and are nonrefundable. 130.
Violations & Fines
A first violation found by the Director can suspend the license up to 30 days, a second up to 90 days, a third up to 120 days, and a fourth within any five-year period means automatic revocation. Violations can also be charged as a misdemeanor under Chapter 1.12 or as an infraction, plus an administrative citation under Chapter 1.13 and civil injunction. After a revocation, no new license issues for that location for five years.
