Chapter 17.69, Restrictions on Tobacco Retailers, was adopted in 2015 to keep tobacco and vaping products away from children, citing findings that most first-time youth smoking happens before age eighteen. Section 17.69.020 defines 'tobacco retailer' broadly to include any business where tobacco product sales, including electronic smoking devices, account for more than fifty percent of revenue, or that advertises itself as a tobacco or smoke shop; it also defines 'electronic smoking device' to cover e-cigarettes, vape pens and their components such as cartridges and e-liquid.

Section 17.69.030 is the operative location rule: a tobacco retailer is otherwise allowed wherever the zoning district permits retail use, but it cannot be located, established or operated within one thousand feet of any developed or general-plan-designated school providing primary or secondary education, or within one thousand feet of another existing tobacco retailer, with distances measured parcel line to parcel line. Section 17.69.040 grandfathers retailers that were lawfully operating before the chapter's 2015 effective date; they may continue as a legal nonconforming use, but that status is lost if the use is abandoned for ninety continuous days, and the nonconforming use cannot be enlarged, expanded or extended.
