West Valley City, UT Business Licensing & Operations: Tobacco Retail License (2026)

Section 7-7-121(1)(b) defines a Retail Tobacco Specialty Business as a commercial establishment where tobacco product sales make up more than 35 percent of annual gross receipts, food and beverage sales (excluding gasoline) fall under 45 percent of receipts, and the business isn't licensed as a pharmacy under Title 58, Chapter 17b of the Utah Code. That definition, not the store's name or signage, decides whether the buffer rules apply. Subsection (2) then sets three distance floors: 1,000 feet from a defined 'Community Location,' which covers public and private K-12 schools, licensed child-care facilities and preschools, trade or technical schools, churches, public libraries, playgrounds, parks, youth centers, public recreational facilities, and public arcades; 600 feet from another Retail Tobacco Specialty Business; and 600 feet from any Residential or Agricultural Zone or Use.

Subsection (3) fixes how those distances are measured: a straight line from the shop's nearest entrance to the nearest property boundary of the protected location, ignoring intervening structures or zoning districts, so a shop can't rely on an intervening building or a zoning line to shrink the effective distance. Subsection (4) grandfathers in a shop that held a business license and was lawfully operating on or before May 8, 2012, so long as the license has been continuously renewed without relapse or permanent revocation, the business hasn't suspended tobacco sales for more than 60 consecutive days, its premises or operations haven't substantially changed, and it still complies with other applicable laws, including zoning ordinances and building codes.
