Eagan, MN Cannabis Regulations: Buffer Zones (2026)

Eagan's cannabis buffer rules live in City Code § 11.70, Subd. 36, the subdivision the city adopted to regulate cannabis businesses under Minn. Stats. Ch. 342. Subdivision 36.D.3 sets the core spacing rule: no cannabis business may locate or operate within 350 feet of an existing lawful cannabis business, with the distance measured along a line from the nearest exterior wall of the existing business's retail store or occupied space to the nearest exterior wall of the proposed business's retail store or occupied space, even inside a shared multi-user building.

That buffer runs between cannabis businesses only; the code does not set a separate distance from schools or parks. Two other buffers protect residential areas rather than other businesses. Under Subdivision 36.G.1(b), a temporary cannabis event, which the office of cannabis management may license for up to four days, must keep its setback from any residential-use or residential-zoned property line to no less than 200 feet, and the event is confined to zoning districts where an outdoor cultural or entertainment event is already allowed. Under Subdivision 36.H.4, outdoor cannabis cultivation, which also requires a minimum six-foot, 100 percent opaque commercial or security-grade fence around the growing area, must keep any portion of the cultivation area at least 200 feet from residential-used or residential-zoned property.
