Summary

Elgin bars adult-use cannabis craft growers, cultivation centers, processors, infusers and transporters from operating within 250 feet of any preschool, elementary or secondary school, day care center or home, college, university, or public park or forest preserve. The city's development administrator measures that distance from the nearest lot line, or from the tenant space's demising wall inside a shared building, to the protected use's own lot line.

A.In addition to all state-imposed minimum distance limits, an adult-use cannabis craft grower [SR] shall not be located within two hundred fifty (250) feet of a preexisting public or private preschool or elementary or secondary school or day care center, day care home, group day care home, part-day childcare facility, college, or university, or a publicly-owned or -operated park or forest preserve. The two hundred fifty (250) foot distance limit in this subsection A shall be measured in a straight line from the nearest lot line [SR] of the adult-use cannabis craft grower [SR] to the nearest lot line [SR] of the land use [SR] from which the setback is sought, provided that if an adult-use cannabis craft grower [SR] is to be situated in a distinct tenant space within a multi-tenant building, then the setback described in this subsection A shall be measured from the nearest demising wall of the distinct tenant space within the building in which the adult-use cannabis craft grower [SR] is proposed to the nearest lot line [SR] of the land use [SR] from which the setback is sought.

Full Breakdown

015: adult-use cannabis craft growers, cultivation centers, processing organizations, infuser organizations and transporting organizations all carry the identical distance standard, measured in a straight line from the nearest lot line of the cannabis facility to the nearest lot line of the protected school, day care, college, university, park or forest preserve. Where a facility occupies only part of a multi-tenant building, the setback runs instead from the nearest demising wall of that tenant space. Adult-use cannabis dispensing organizations, the retail storefronts, carry a related but separately worded 250-foot rule with narrow carve-outs for small Center City pocket parks.

Beyond the distance itself, every one of these cannabis business types must operate entirely inside a fully enclosed building, cannot be located inside a house, apartment, condominium or any residentially zoned area, and cannot be established as an accessory use to any other land use except another cannabis business establishment. 5-by-11-inch sign stating that prohibition must be posted where patrons can see it. 65 must include an odor-control plan, an inventory-control plan, a floor plan, a cannabis-waste disposal plan, and a security and lighting plan; the Elgin police department reviews the security package and forwards its recommendation to the planning and zoning commission before the public hearing. 14's industrial architectural standards, and the operator must file copies of all required state licenses with the development administrator before any occupancy permit issues.

Violations & Fines

Because the buffer is a condition of a conditional-use permit granted under chapter 19.65, violating it can trigger revocation of that approval. Under section 19.80.050, Elgin's code enforcement officer, also the zoning officer, may inspect the property, issue a citation, order a stop-work order on ongoing construction, or refer the matter for legal proceedings. Separately, chapter 6.07 sets a minimum $500 fine for any cannabis business establishment that violates its provisions, with each day of a continuing violation charged as a separate offense.

Frequently Asked Questions

Does Elgin's 250-foot cannabis buffer apply to grow facilities as well as stores?
Yes. Section 19.90.015 applies the identical 250-foot distance rule to adult-use craft growers, cultivation centers, processing organizations, infuser organizations and transporting organizations, measured from the facility's nearest lot line to the nearest lot line of the protected school, day care, college, park or forest preserve.
Can a cannabis cultivation facility share a building with another business in Elgin?
Only with another cannabis business establishment. Section 19.90.015 bars a craft grower, cultivation center, processor, infuser or transporter from being established as an accessory use or component of any other land use, except a co-located cannabis business, and even then not a dispensing organization.
What happens if a cannabis facility in Elgin doesn't control odor?
Its conditional-use application must include an odor control plan before approval, and the development administrator can enforce compliance afterward; failing to control odor or otherwise violating the facility's approved conditions can lead to a citation or revocation of the conditional use.
