Full Breakdown
Section 6-2-32 (Cannabis Facilities) permits cannabis dispensing organizations only in the B2, B3, HS, I, ORI, and RD zoning districts, and caps the City at three dispensaries total; no fourth application can even be accepted while three permits are issued or reserved. Within those districts, a dispensary cannot sit within 1,000 feet of a pre-existing primary or secondary school, a definition that pointedly excludes learning centers, fitness facilities, preschools, day care centers, residential care homes, and vocational/trade centers. A dispensary also cannot sit within 250 feet of property zoned for residential use under Chapter 6, or within one mile, measured as 5,280 feet, of another existing dispensary.
All these distances run property line to property line unless the Zoning Administrator grants a variance. Medical cannabis cultivation centers, allowed only as a conditional use in the I, ORI, and RD districts, face their own 2,500-foot residential buffer and must also meet the school-distance rules in the state Compassionate Use of Medical Cannabis Program Act. Several outright prohibitions sit alongside the buffers: craft growers, processing organizations, transporting organizations, non-medical cultivation centers, and infuser organizations are banned City-wide in every zoning district. Dispensaries cannot have drive-throughs, cannot display cannabis or paraphernalia visibly from outside, cannot allow on-site consumption or off-site delivery, cannot use vending machines, and cannot operate out of a home, apartment, or condominium.
Applicants must file a dispensary application with the Zoning Administrator that includes a security plan coordinated with the Chief of Police, a ventilation plan to contain odor, and proof of the applicant's state license. Reserved permit slots expire if an applicant shows no meaningful progress for three months.
Violations & Fines
Operating a prohibited cannabis business, or a dispensary or cultivation center that violates a buffer or operating standard, is declared a public nuisance under Section 6-2-32's enforcement subsection and can be abated through any legal remedy. Enforcement runs through Section 1-4-1's general penalty: a fine of not less than one hundred dollars and not more than five hundred dollars per offense, with each day of the violation a separate offense.
