Section 10-4-5-4, Public Nuisance, opens with a general duty: it is unlawful for an owner to fail to exercise proper care and control of an animal to prevent it from becoming a public nuisance. Subsection 2 narrows that into a specific noise standard, making it unlawful for an owned animal to make excessive noise in violation of the Section. , giving nighttime barking a far tighter tolerance than daytime barking. 2 sets evidentiary gatekeeping before a complaint can proceed: it must be either accompanied by audio or video recordings showing the noise exceeded the time limit, corroborated by complaints from two or more people living in different households about the same animal in the same time frame, or corroborated by an animal control or law enforcement officer who personally heard the excessive noise during the covered hours.
