Berwyn, IL Cannabis Regulations: Dispensary Zoning (2026)

Berwyn allows adult-use cannabis dispensaries, but only through a narrow special use pathway written into its Zoning Code. Table 1244.02-A in § 1244.02 marks Adult-Use Cannabis Dispensing Organization with an S in the C-2 and C-4 columns and points to § 1244.03(A). The other districts are blank, so the use is not allowed in C-1, C-3, I, P or R-1 through R-4.

Section 1244.03(A)(3) then narrows the map to specific corridors. In C-4, a dispensary is only allowed along Harlem Avenue or Ogden Avenue with a special use permit. In C-2, it is only allowed along Harlem Avenue and Roosevelt Avenue with a special use permit. Under (A)(2), the applicant has to include, with the special use application to the Zoning, Planning and Development Commission, copies of all information submitted to the State of Illinois in its license application, and (A)(9) lets the Zoning Administrator demand additional information during the process.

Operating standards come with the permit. At least 85% of the floor area of the tenant space has to be devoted to dispensing activities authorized by the Act. No operator, employee or agent can open for business or let anyone who is not an employee remain on the premises between 10:00 p.m. and 6:00 a.m. Subsection (A)(7) prohibits on-site consumption and makes the dispensary responsible for enforcing that ban, and (A)(5) requires site security such as lighting, surveillance cameras or fencing. The state rules, including a 1,500-foot minimum spacing from a pre-existing adult-use dispensary, apply on top of the city standards under (A)(1).

The use table also lists adult-use craft growers, infusers, processors and transporters with S marks in C-2 and C-4. Medical marijuana dispensaries are separate: § 1244.03(Q)(2) allows them in C-4 only along Harlem Avenue with a special use permit.
