Blue Springs, MO Cannabis Regulations: Dispensary Zoning (2026)

Section 405.050(A)(34), Marijuana Dispensary, applies before any building may be constructed, altered, or used for a dispensary. The 1,000-foot buffer runs from an existing elementary or secondary school, licensed child day-care center, or church, and the code spells out exactly how to measure it: for a freestanding facility, from the exterior wall closest to the protected use to that use's nearest property line; for a facility inside a larger building such as an office building or strip mall, from the protected use's property line to the dispensary's entrance or exit closest to it; and always along the shortest path a person can lawfully walk between the two points.

The code borrows the definition of 'church' from the state's own marijuana regulations, 19 CSR 30-95.010. Beyond the buffer, every dispensary must keep all operations and all storage of materials, products or equipment fully inside an enclosed building, with no outdoor operations or storage permitted at all, and no marijuana may be smoked, ingested or otherwise consumed anywhere on the premises. Public hours are capped: the business must be closed to the public, closed to non-employees, and cannot sell or deliver marijuana between 10:00 p.m. and 8:00 a.m.

A dispensary cannot be located in any building that also contains a residential dwelling unit, must install ventilation that keeps marijuana odor from leaving the property, must complete site plan review under Section 403.070, and must comply with the video surveillance standards of Section 610.270 and the non-residential design standards of Section 407.090.
