The Boca Raton City Council approved zoning for medical marijuana dispensaries in a 3-2 vote in February 2020, reversing a ban on Medical Marijuana Treatment Centers enacted in 2014. Dispensaries are permitted only in specific commercial zoning districts and must maintain distance buffers from schools, parks, libraries, and other sensitive uses. Only state-licensed MMTCs authorized by the Florida Department of Health may operate. Recreational cannabis dispensaries are not permitted as Florida has not legalized adult-use cannabis.
Operating an unlicensed dispensary or operating in a prohibited zone violates both state law and the zoning code. Violations may result in criminal prosecution and code enforcement action.
