Currently only five existing cannabis facilities are authorized in unincorporated San Diego County. No new cannabis businesses are permitted until the Socially Equitable Cannabis Program is approved, anticipated for summer 2026. New facilities must be 600+ feet from schools, daycare, and youth centers.
As of early 2026, only five existing cannabis facilities within the unincorporated area are allowed to operate. No new commercial cannabis businesses are currently permitted under existing ordinances. The County's Socially Equitable Cannabis Program will allow new commercial cannabis businesses after the Board of Supervisors approves regulatory changes and certifies the Final Program Environmental Impact Report, anticipated for summer 2026. Proposed uses include indoor cultivation, retail, delivery, manufacturing, testing, and distribution. Cannabis facilities cannot be located within 600 feet of a K-12 school, daycare, or youth center. Zoning amendments will specify which business types are allowed and in which zones.
Operating a cannabis business without authorization is a violation of County code and state law. Penalties include fines, closure orders, and potential criminal charges.
