Newport Beach, CA Cannabis Regulations: Dispensary Zoning (2026)

Newport Beach has enacted a comprehensive ban on all commercial cannabis activities within city limits. NBMC prohibits the establishment or operation of cannabis dispensaries, retail stores, delivery services, manufacturing facilities, testing laboratories, distribution centers, and cultivation operations for commercial purposes. The city exercised its local authority under California Business and Professions Code Section 26200 (Proposition 64 MAUCRSA framework) to opt out of allowing any commercial cannabis land uses. No zoning district in Newport Beach permits cannabis business operations. This ban extends to both storefront dispensaries and non-storefront delivery-only operations. Mobile delivery services based outside the city may deliver to Newport Beach addresses under state law, but cannot establish a physical presence or base of operations within city limits. The City Council has periodically reviewed and reaffirmed the ban. Medical cannabis patients may obtain products through licensed dispensaries in neighboring cities such as Santa Ana. Personal possession and indoor cultivation for personal use remain legal under state law.
