Summary

North Las Vegas has not opted out of cannabis: every marijuana establishment, from cultivation to retail, is a permitted land use here, but only after a special use permit and proof the state Department of Taxation has already accepted the license application. Approved establishments must operate from a stand-alone building, in an appropriately zoned district, with a single public entrance and no outside storage.

b.Permit Required. All marijuana establishments within the City of North Las Vegas require a special use permit. Requests for a marijuana establishment may only be filed with the City when the applicant submits verification that an application for a license has been accepted by the Department of Taxation for the particular marijuana establishment and location. In addition, the applicant must provide evidence that the applicant owns the property on which a marijuana establishment is proposed or has written permission of the property owner to operate the proposed marijuana establishment. ... f.Standards for Marijuana Establishments.(i)The following development standards shall apply to all marijuana establishments:(1)Must be located in a separate, stand-alone building or facility.(2)Must be located in an appropriate zoned district. ... (5)A single entrance shall be provided for the marijuana establishment, except for additional exits that may be required to comply with life safety requirements...(6)No outside storage on-site shall be permitted, including the use of shipping containers for on-site storage.

Full Breakdown

" The applicant must also show ownership or written permission from the property owner. " No outside storage, including shipping containers, is allowed at any marijuana establishment. Special use permits expire automatically one year after approval if conditions aren't met, and again the moment the state Department of Taxation registration certificate lapses, meaning a cannabis business can't keep operating locally once its state license goes inactive.

Violations & Fines

A marijuana establishment operating without a valid, currently effective special use permit, or one whose state Department of Taxation registration has lapsed, is operating in violation of Title 17. Under Section 17.28.200, that draws a written correction order from the Director and, on continued noncompliance, a misdemeanor charge carrying a fine up to $1,000, up to six months in jail, or both, with each day of continued operation a separate offense.

Frequently Asked Questions

Has North Las Vegas banned marijuana businesses?
No. Section 17.20.020.C.29 sets up a permitting pathway rather than a ban: every marijuana establishment type requires a special use permit and must meet zoning standards, but the City accepts applications once the state Department of Taxation has accepted the license request.
Can a cannabis business share a building with another tenant in North Las Vegas?
No. Section 17.20.020.C.29.f.(i)(1) requires every marijuana establishment to be located in "a separate, stand-alone building or facility," and subsection (4) bars any other activity from occurring within that facility.
What happens to a marijuana establishment's local permit if the state license lapses?
The special use permit "shall expire by operation of law and be deemed null and void at 12:01 a.m. the calendar day after the applicant's registration certificate issued by the Department of Taxation expires," per Section 17.20.020.C.29.e.(i)(4).
