Old Bridge, NJ Cannabis Regulations: Dispensary Zoning (2026)

Old Bridge Township Code § 250-42B(18) prohibits all classes of cannabis establishments, cannabis distributors, and cannabis delivery services, as those terms are defined in Section 3 of P.L. 2021, c. 16 (N.J.S.A. 24:6I-33), whether for medicinal or recreational purposes, including businesses that manufacture, sell or dispense cannabis-related paraphernalia, from operating anywhere in the Township. Subsection (19) extends the same townwide ban to marijuana and medical-cannabis cultivation, production or manufacturing facilities, testing facilities, wholesale or retail stores, dispensaries, and medical delivery services. Both subsections carve out one exception: they do not stop a delivery service based outside Old Bridge's municipal boundaries from delivering cannabis items or medical marijuana to an address inside the Township.

As with the rest of § 250-42, the prohibition is absolute under § 250-42A, meaning no use variance under N.J.S.A. 40:55D-70d or § 250-9G(5) can authorize a cannabis business location; only a Township Council ordinance repealing or amending § 250-42 could open any zone to dispensaries, cultivators or testing labs. These provisions were added by Ordinance No. 2019-05 and amended by Ordinance No. 2021-15, reflecting Old Bridge's formal opt-out under the state Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act.
