Summary

Roseville, Minnesota registers cannabis retailers instead of banning them, but caps the number: the city issues one registration per 12,500 residents, using the state demographer's population estimate rounded up. Retail sales without an active city registration are prohibited under Roseville City Code § 316.04.

(a) Limit on number of cannabis retailer registrations. (1) The city will issue one registration per 12,500 residents in the city. (2) The number of registrations available will be calculated by dividing the state demographer's estimate of the city's population by 12,500 and rounding up to the nearest whole number. (3) The city will update the number of registrations available based on the most recent data available from the state demographer on January 1 and June 1 each year. (4) If the number of registrations available in the city decreases for any reason, businesses with current registrations will be allowed to maintain and renew their registrations, but no new registration will be issued. (5) Registrations issued to businesses with a license preapproval will count toward the city's registration limit. (b) The following businesses are not subject to the cap on registration under subsection (a) of this section: (1) Lower-potency hemp retailers; and (2) Medical cannabis combination businesses.

Full Breakdown

Section 316.04 requires every cannabis retailer and lower-potency hemp retailer to register with the city before making retail sales to customers or patients, and sales without an active registration are prohibited. Section 316.05(a) then limits the count. The city issues one registration per 12,500 residents, calculated by dividing the state demographer's estimate of the city's population by 12,500 and rounding up to the nearest whole number. The city updates the number of registrations available from the most recent state demographer data on January 1 and June 1 each year. If the number falls, existing registrants keep and renew their registrations but no new one is issued. Registrations issued to businesses holding a license preapproval count toward the limit. Lower-potency hemp retailers and medical cannabis combination businesses sit outside the cap under § 316.05(b).

Applications are processed first-come, first-served once the city has a complete application and payment of all fees (§ 316.06). A complete application includes the property owner's name, the applicant's name and date of birth, the address and parcel ID, a certification of compliance, and a copy of a valid state license or written notice of OCM license preapproval (§ 316.07). Appendix A of the code lists the retailer registration fee at $500.00 for the initial registration and $1,000.00 for renewal, and $125.00 for a lower-potency hemp retailer. Section 316.07 says the initial fee covers the first year, the renewal fee for year two is paid at the same time, and the fees are nonrefundable. A registration is not transferable to another person, entity, or location (§ 316.11).

Zoning still decides the location. Section 316.09 bars a registration when the applicant does not comply with applicable zoning and land use regulations, is not current on property taxes and assessments at the site, or when the maximum number has been issued. In the E-1 and E-2 employment districts, § 1011.12(f)(11) subjects a cannabis or hemp retailer to the limit in § 1011.12(f)(2), which requires retail to sit in buildings or complexes that include office or other employment-related uses and caps it at 25 percent of the building or complex. Retail hours under § 316.14(b) run 8:00 a.m. to 10:00 p.m. Monday through Saturday and 10:00 a.m. to 9:00 p.m. on Sunday.

Violations & Fines

Operating without registration breaks § 316.04. Under § 316.13, any violation of chapter 316 is a misdemeanor with each day a separate offense, plus administrative fines set in the city fee schedule, and it is grounds for action against any city business license. Under § 316.12 the city can fine or suspend a registration after written notice and a ten day window to request a hearing, with appeal to the city council within ten days of the hearing officer's order.

Frequently Asked Questions

Has Roseville opted out of cannabis retail?
The code does not ban retail. Chapter 316 sets up retailer registration instead: § 316.04 requires registration before retail sales, and § 316.05 limits the city to one registration per 12,500 residents. Applicants still need the state OCM license and must satisfy Roseville zoning and land use rules.
How many cannabis retailers can Roseville register?
Section 316.05(a) divides the state demographer's estimate of the city's population by 12,500 and rounds up to the nearest whole number. The city recalculates from the latest demographer data on January 1 and June 1. If the number drops, current registrants renew but no new registration is issued.
Do hemp shops count against the Roseville cap?
No. Section 316.05(b) exempts lower-potency hemp retailers and medical cannabis combination businesses from the cap. Lower-potency hemp retailers still must register under § 316.04, and Appendix A lists a $125.00 initial and renewal fee for them.
What happens if Roseville has already issued the maximum registrations?
Section 316.09(6) says the city shall not issue a registration when the maximum number under § 316.05 has been issued. Applications are taken first-come, first-served once complete (§ 316.06), and a pre-license certification is not an application for registration.
Can a Roseville cannabis registration be moved to a new location?
No. Section 316.11 states a registration is not transferable to another person, entity, or location. A business that relocates needs its own registration for the new address, and § 316.09 requires zoning and land use compliance at that location.
