Dallas voters approved Proposition R (the Dallas Freedom Act) in November 2024 to decriminalize possession of up to 4 ounces, but this does not legalize cultivation. The measure is currently stayed pending legal challenges from the Texas Attorney General on state preemption grounds.
Dallas does not permit home cannabis cultivation under state law. Both recreational and medical marijuana growing are prohibited. Any cannabis plants found on residential property may be seized and the owner faces potential criminal penalties including fines and imprisonment. CBD hemp cultivation may have separate agricultural regulations.
