Commerce City, CO Curfew Laws: Juvenile Curfew (2026)

Section 12-7001 of the Commerce City Revised Municipal Code makes it unlawful for any minor to loiter, idle, wander, stroll, or play in or upon a public street, alley, sidewalk, park, playground, schoolyard, public building, or other public place between 11:00 p.m. and 5:00 a.m. The curfew carries six built-in exceptions: a minor accompanied by a parent or guardian, one running an errand a parent or guardian directed, one engaged in employment, including the commute directly to or from work, one responding to an emergency, one exercising First Amendment rights or returning directly home from doing so, and one attending or returning directly home from an official school, church, or civic activity.

The Code pairs the curfew with two related Article VII sections: section 12-7002 makes it unlawful for a parent, legal guardian, or other adult with custody and control of a minor to fail to exercise reasonable care to prevent the minor from violating any city ordinance, other than traffic offenses, and a conviction there can include a restitution order to any victim of the minor's misconduct. Section 12-7003 separately criminalizes knowingly sheltering a minor without parental consent under specific conditions, such as failing to notify the parent within 24 hours or refusing to disclose the minor's location to police.

Commerce City Police enforce the curfew on patrol during overnight hours citywide, including in the Reunion and Northern Range residential areas, and an officer who encounters a minor out after 11:00 p.m. must assess whether one of the six statutory exceptions applies before issuing a citation to the minor or referring the matter for a parental failure-to-supervise charge.
