Muncie, IN Curfew Laws: Juvenile Curfew (2026)

The Muncie Common Council's curfew ordinance, enacted by Ord. No. 5-06 in February 2006, sets two age-based schedules in Chapter 92, Division 1. Section 92.03 bars a 15, 16, or 17 year old from being in a public place between 1:00 a.m. and 5:00 a.m. on Saturday or Sunday, after 11:00 p.m. on Sunday through Friday nights, or before 5:00 a.m. on Monday through Friday. Section 92.04 covers younger children: anyone under 15 cannot be in a public place after 11:00 p.m. or before 5:00 a.m. on any day of the week.

Section 92.05 lists eight exceptions that let a minor avoid a violation, including being with a parent or an adult the parent designated, traveling to or from a job, a school-sanctioned activity, a religious event, an emergency, a supervised nonprofit or government program, or interstate travel that only passes through Indiana. Section 92.01 also makes clear the curfew division does not otherwise excuse a minor from any place the Code already bars them from at any hour. Section 92.06 puts enforcement in the hands of the Muncie Police Department: officers file a complaint with the Delaware County Juvenile Circuit Court and send a copy to the minor's parent, guardian, or custodian whenever one can reasonably be identified.

Section 92.07 extends liability to a parent, guardian, or custodian who recklessly allows a curfew violation, and a second violation creates a presumption that the adult is responsible.
