Smyrna, GA Curfew Laws: Park Curfew (2026)

Section 70-1 of the Smyrna Code, as rewritten in its entirety by Ord. No. 2018-06 on 2-19-18, sets a park curfew that follows the posted sign first and the sun second. A park has its own closed hours, and a person inside the bounds of the park during those hours is in violation. If a sign does not designate the closed hours, the code assumes the park is closed between dusk and dawn. The only carve-out is for anyone engaged in any kind of organized activity, such as participating in sports as a player, coach or official, and the section says that includes being a spectator at such an activity.

Three other pieces of Chapter 70 attach to the curfew. Section 70-2(c)(3) makes it unlawful to park any vehicle on the drives, avenues or parking lots of a public park between closing and opening hours, and it puts the hours of operation in the hands of the parks and recreation department. Section 70-2(b) gives park rangers arrest powers concurrent with the police department and the power to eject a person from a park or public facility. Section 70-2(e) lets an authorized park employee, park ranger or law enforcement officer order a person to leave immediately, after which the person cannot return or use park facilities for 24 hours; refusing the order, or coming back inside the 24 hours, is unlawful and punishable as a misdemeanor.

Section 70-2(c)(19) also bars entry to any locked or closed sport field for recreational use unless approved by permit from the director or the director's designee.
