Under Section 3.20.1(c) of Irving's Unified Development Code, a new data center is permitted as a principal use by Conditional Use Permit (CUP) only, and a CUP application may be made only in the C-W, ML-20, ML-20a, ML-40, ML-120, or C-P districts. Principal-use buildings must sit back 300 feet from any residentially zoned property, cap at 75 feet, and fully screen all ground-mounted and rooftop equipment. Accessory data centers (max 1,000 square feet, 15 feet tall) are allowed in the P-O, C-O, C-N, C-C, and FWY districts. Adopted by Ordinance 2025-11063.
Violations & Fines
A person who violates the data center standards is fined, upon conviction, not less than $1.00 nor more than $2,000.00, and each day of noncompliance is a separate offense.
