Parsippany-Troy Hills, NJ Environmental Rules: Boat Dock Permits (2026)

Docks in the Township of Parsippany-Troy Hills are handled through the land constraint provisions of the land use chapter, not a separate dock licensing chapter. Section 225-79 designates land constraint areas: the flood hazard area, wetlands, stream areas, critical slopes of 15% or greater, and pond or lake areas. A pond or lake area is any nonflowing body of water with a mean depth of four feet and a surface area greater than one acre, including areas created for retention or detention purposes.

Section 225-80B, Regulations for stream, pond and lake areas, says that no building, parking lot or other impervious surface can be erected or constructed, above or below ground level, within 50 feet of the edge of any pond, lake or stream. The same subsection then lists permitted uses in lake areas: conservation of soil, vegetation, water, fish and wildlife; fishing, swimming and boating; and dock, pier, boathouse and marina construction in accordance with all other provisions of all Township ordinances. Each use must not disturb the natural and indigenous character of the area and must be permitted under the other Township ordinances.

The section prints no dock permit form, fee, length limit or design standard. A dock project therefore depends on the other Township ordinances it points to, including the Flood Hazard Protection chapter, Chapter 175.

Section 225-80A adds that no building, parking lot or other impervious surface goes into a flood hazard area or wetlands area unless a permit has been issued by the New Jersey Department of Environmental Protection under the Freshwater Wetlands Protection Act, or by the U.S. Army Corps of Engineers under Section 404 of the Clean Water Act if the project is exempt from that Act.

Section 225-81 offers relief. An applicant who shows through topographic maps or soil tests, confirmed on-site by the Township Engineer and the Morris County Soil Conservation District, that a property is misclassified can receive full or partial relief from the Construction Official or the Board considering the application. Waiver requests are made at the time of application.
