Toledo, OH Environmental Rules: Boat Dock Permits (2026)

Toledo Municipal Code § 1104.1400 makes 'Marinas', the zoning use covering commercial docking, mooring and boat storage facilities, subject to a detailed set of standards in §§ 1104.1401 through 1104.1409. But § 1104.1401 carves out an exception for ordinary homeowners: the mooring, berthing, or securing of recreational boats is exempt from the marina requirements where it is exclusively an accessory use to a residential use, and the number of boat berths does not exceed two per dwelling unit, to a maximum of six per parcel.

A private dock within that limit needs no marina-level zoning approval. Cross the threshold, or operate a marina as the principal use, and the code applies real numeric standards: a minimum 1-acre lot with at least 130 feet of shoreline width (§ 1104.1403); a marina basin whose channelward edge must keep a 50-foot setback from piers, pilings, slips and buoys, with 25 feet of open water along side-lot-line extensions for navigation (§ 1104.1404); paved street frontage of at least 50 feet and dust-controlled storage surfaces (§ 1104.1405); watercraft repair areas set back 100 feet from residential districts (§ 1104.1406); shielded, non-glare lighting (§ 1104.1407); and, for any marina docking more than seven boats, sanitary facilities meeting Ohio Revised Code §§ 3733.21-3733.30 and OAC Chapter 3701-35, plus connection to the public sanitary sewer approved by the Department of Engineering Services (§ 1104.1408).
