Canton, OH Environmental Rules: Erosion Control (2026)

Canton's Storm Water Management chapter, Codified Ordinances Chapter 961, was adopted by Ordinance 200-2009 to meet National Pollutant Discharge Elimination System Phase II requirements and folds erosion control into the city's broader storm water program rather than a stand-alone erosion ordinance. Section 961.01 states the chapter's purpose is to control the rate, volume and quality of runoff so that flooding and erosion potential are not increased, and to control non-point source pollution and stream channel erosion. Section 961.02(e) defines "Construction Site Storm Water Quality Management" as the implementation of proper Best Management Practices on construction sites to control erosion and sediment and reduce pollutants in runoff.

Those BMPs are drawn from the City of Canton Storm Water Management Manual adopted under Section 961.05, which the City Engineering Department maintains and may update based on engineering, science and federal or state regulatory changes. The Director of Public Service or designee administers the program, and representatives of the City Engineering, Health and Fire Departments may inspect a construction site under Section 961.11 to confirm compliance, entering permitted sites without prior consent. A property owner who fails to correct erosion or sediment problems after a written Notice of Violation under Section 961.13 can face a Stop Work Order, an administrative hearing, and civil proceedings brought by the Law Director, in addition to the administrative and criminal penalties set out in Section 961.99.
