Full Breakdown
Adopted by Ordinance No. 8748 on November 22, 2021, the Land Disturbance Code covers any activity in Florissant that clears vegetation, grades the ground or otherwise breaks the topsoil. It splits regulated work into ordinary land disturbance, under one acre, and major land disturbance, one acre or more or a smaller phase of a project that will ultimately reach an acre, with major projects triggering plan review by the Engineering Division and permit issuance coordinated with the Metropolitan St. Louis Sewer District (MSD) and, where applicable, the Missouri Department of Transportation or St.
Louis County Department of Highways and Traffic. The code defines Best Management Practices as the erosion- and sediment-control measures required on a site, and requires a Storm Water Pollution Prevention Plan (SWPPP) whenever a project must comply with the city's Missouri MS4 NPDES permit obligations. The Department of Public Works receives and processes ordinary land disturbance permit applications, administers site development escrows, and inspects active sites, including any within or abutting the 100-year floodplain. Owners who start work without a permit face a separate no-permit penalty of up to $1,000 per day, assessed by the responsible department and appealable, at the violator's option, by depositing the assessed amount in escrow pending a hearing before the Building Code Board of Appeals.
Violations & Fines
Violating any provision of the code, including working without a required permit or against an approved SWPPP, is a misdemeanor punishable by a fine of up to $1,000 and up to 30 days in jail, with each day of continued violation a separate offense. The city must first give written notice, and the violator has 10 days to abate before penalties or a stop-work order attach. Decisions can be appealed to the Building Code Board of Appeals within 30 days for a $100 filing fee.
