Fontana, CA Environmental Rules: Erosion Control (2026)

Sec. 9-26, added by Ord. No. 1879 on February 8, 2022, adopts by reference the county code sections controlling blowing sand and preventing wind-driven soil erosion, along with the county's permitting and fee structure and its penalty provisions for violations; three certified copies are kept on file with the city clerk for public inspection. Sec. ' Sec. 9-28 extends the article to all land currently within the city or later annexed to it, as long as it falls within the territorial boundaries described in the adopted county sections.

Rather than building a separate city bureaucracy, Sec. 9-29 keeps administration where it already sits: all permits required under the article are issued by, and all administrative enforcement proceedings conducted by, the county agricultural commissioner and the county soil erosion and dust prevention commission, with all fees and costs paid directly to the county. Sec. 9-30 draws one boundary around the scheme: it does not apply to abatement of weeds declared a public nuisance under the city's separate weed-abatement provisions, keeping erosion permitting and nuisance weed abatement on two distinct tracks even though both can involve disturbed or vacant land.
